Terms of service

These Terms of Service (“Terms”) apply to all websites, information, communications, products, digital planning services, logistical services, and other services provided by CC Lab Technology Limited, Smile Aid GmbH, and Clear Technology Inc., collectively referred to as “Orthoclear.”

These Terms apply to any agreement between Orthoclear and the Customer regarding the use of the website, the request of a 3D plan, the purchase of clear aligners, retainers or other products, and any related services provided by Orthoclear.

By using the website or services of Orthoclear, you confirm that you have read and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the website or services.

Orthoclear does not provide dental or medical care. Orthoclear supplies the aligner system, digital planning, logistical support, and related products and services. Clinical evaluation, dental procedures, and treatment are independently performed by licensed dentists.

These Terms do not apply to the professional relationship between a patient and a treating dentist.

Article 1 – Definitions

For the purposes of these Terms, the following definitions apply:

Orthoclear
Refers collectively to:

  • CC Lab Technology Ltd, registered in Dublin, Ireland, Companies Registration Office Ireland number 567494

  • Smile Aid GmbH, registered in Berlin, Germany, District Court Berlin (Charlottenburg) HRB 246469

  • Clear Technology Inc., registered in Delaware, United States, Department of State: Division of Corporations number 7666827

Clear Aligners
Transparent aligners supplied by Orthoclear, manufactured based on a digital 3D plan, and worn by the patient as part of a treatment process guided by a dentist.

3D Plan
A digital simulation and planning process based on dental scans or other dental data used to design and manufacture the aligner system.

Customer
The person who enters into an agreement with Orthoclear to request a 3D plan or purchase clear aligners, retainers, or other products or services.

Patient
The individual whose teeth are assessed or treated using Orthoclear products. The patient may, but does not have to be, the same person as the Customer.

Services
The non-clinical services provided by Orthoclear, including digital planning, logistical support, customer support, informational services, software or app functionality, and related support services.

Products
Products supplied by Orthoclear, including but not limited to clear aligners, retainers, and related accessories.

Dentist
An independently practicing dentist or dental practice responsible for clinical evaluation, dental procedures, and supervision of the treatment.

Dental Procedures
Procedures that may only be performed by a dentist or under the responsibility of a dentist, including dental check-ups, clinical evaluation, IPR (interproximal reduction), and other dental treatments.

Agreement
The agreement between Orthoclear and the Customer concerning the purchase of products or services from Orthoclear.

Article 2 – General

  1. These Terms apply to the formation and execution of any agreement between the Customer and Orthoclear.

  2. Orthoclear may use third parties where necessary to perform its services.

  3. These Terms also apply to agreements for which Orthoclear engages third parties.

  4. Deviations from these Terms are only valid if agreed in writing.

  5. The applicability of any general terms used by the Customer is explicitly rejected.

  6. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force.

Article 3 – Age Requirements

  1. Customers must be at least 18 years old to enter into an agreement with Orthoclear.

  2. If the patient is a minor, parental or legal guardian consent is required.

  3. Orthoclear reserves the right to refuse agreements that do not meet the applicable age or consent requirements.

Article 4 – The Agreement

  1. The agreement between Orthoclear and the Customer may consist of two components:

    a. requesting and paying for a 3D plan
    b. purchasing clear aligners or other Orthoclear products.

  2. The agreement for a 3D plan is concluded once the Customer confirms the request and completes payment.

  3. The agreement for clear aligners is concluded once the Customer approves the 3D plan and places an order for aligner production.

  4. The 3D plan is a digital simulation and planning tool and does not constitute a medical diagnosis.

  5. The final clinical decision to start treatment is made by the treating dentist.

  6. If the dentist determines that the patient is not suitable for treatment, the dentist may decide not to proceed or to modify the treatment.

  7. The Customer remains responsible for fulfilling obligations arising from the agreement.

Article 5 – Offers

  1. All offers and price quotations by Orthoclear are non-binding unless explicitly stated otherwise.

  2. Offers may not be combined with other promotional programs unless explicitly indicated.

Article 6 – Execution of the Agreement

  1. The Customer and/or patient must provide all necessary information required for Orthoclear to perform its services.

  2. Orthoclear may suspend performance if required information is not provided in time.

  3. The Customer and patient are responsible for the accuracy and completeness of the provided information.

Article 7 – Modification of the Agreement

Orthoclear may modify agreements where necessary due to regulatory or legal changes or where required for proper execution of services.

Article 8 – Suspension and Termination

Orthoclear may suspend or terminate agreements where the Customer fails to meet contractual obligations or where circumstances prevent reasonable execution of the agreement.

Article 9 – Intellectual Property

All intellectual property rights relating to Orthoclear materials, products, software, or website content remain the exclusive property of Orthoclear or its licensors.

No content may be copied or reproduced without written permission from Orthoclear.

Article 10 – Pricing

  1. Prices for Orthoclear products and services are published on the website or confirmed during purchase.

  2. Prices typically include applicable taxes unless stated otherwise.

  3. Dental care performed by dentists is not included in the Orthoclear product price unless explicitly stated.

  4. Dental services are invoiced separately by the dentist.

Article 11 – Payment

  1. Payment for Orthoclear products and services must be made using the payment methods indicated by Orthoclear.

  2. Orthoclear may offer installment payment options through third-party payment providers.

  3. Orthoclear may provide refunds, discounts, or rebates to Customers as part of promotional or commercial arrangements.

  4. Such refunds relate solely to the commercial relationship between Orthoclear and the Customer and do not replace dental invoices issued by dentists.

Article 12 – Liability

Orthoclear’s liability is limited to the amount covered by its liability insurance or the amount paid by the Customer for the relevant product or service.

Orthoclear is not liable for:

  • clinical decisions by dentists

  • incorrect information provided by the Customer or patient

  • indirect or consequential damages.

Article 13 – Best Efforts Obligation

Orthoclear provides its services under a best-efforts obligation and does not guarantee specific results.

The 3D plan represents a simulation of possible tooth movement and does not guarantee a particular outcome.

Article 14 – Force Majeure

Orthoclear is not liable for failure to perform obligations due to events beyond its reasonable control including natural disasters, government restrictions, pandemics, supply chain disruptions, or other force majeure events.

Article 15 – Retention of Title

Products remain the property of Orthoclear until full payment has been received.

Article 16 – Indemnification

The Customer indemnifies Orthoclear against third-party claims resulting from misuse of products or failure to follow instructions.

Article 17 – Personal Data

Orthoclear processes personal data in accordance with applicable privacy laws and its Privacy Policy.

Medical or dental information is handled by the treating dentist.

Orthoclear strives to provide high-quality products and services.
